Business Litigation

The firm handles a wide variety of business litigation matters, including employment, contract disputes, and bad faith litigation. Construction Law

Our attorneys have extensive experience and expertise in defending construction law cases.  Our attorneys combine legal expertise with technical knowledge and practical construction site experience.  We routinely represent owners, engineers, architects, design professionals, general contractors, construction managers, and subcontractors.  Our clients range from large national construction companies to individual home improvement contractors.  In addition, we are approved panel counsel for several national insurance companies to defend construction litigation matters.  Our attorneys are active in construction industry trade associations and lecture industry groups on construction law issues arising from both bodily injury and construction defects.

 

Transportation

The firm represents a wide variety of trucking companies from small local companies to national and international companies, including truckload carriers, LTL carriers, moving companies, tank trucks, and overnight delivery service companies.  Our lawyers have experience handling all aspects of trucking-related matters including accident cases, cargo claims, and contractual-based claims.

As part of our trucking/transportation practice, our lawyers regularly provide seminars to trucking companies, insurance companies, and industry groups regarding all aspects of transportation-related claims.  Our attorney’s are members of transportation-related groups including the American Trucking Association (Safety & Loss Prevention Management Counsel), Transportation Lawyers Association, Massachusetts Trucking Association, and the Defense Research Institute (Trucking Law Committee).  Our attorneys have written numerous transportation articles in industry trade journals.

 

Premises Liability / Criminal Acts of Third Parties on Premises

The firm has handled a wide variety of premises liability exposures. The firm has represented numerous owners, lessors and managers of property in suits arising out of slip and falls, injury due to defect, and dangerous conditions resulting in serious personal injury and/or death. In addition, the firm has handled numerous cases primarily in the commercial contest arising out of criminal acts of third parties on premises such as hotels, restaurants and other public venues. Such cases have involved allegations of liquor liability, assault and battery, rape and murder.

 

Malpractice

The firm handles a wide variety of professional malpractice claims including medical, pharmacutical, and attorney claims.

 

Product Liability

The firm has longstanding expertise in all areas of product liability, directly representing numerous self-insured manufacturers as well as serving as insurer assigned defense counsel to manufacturers, wholesalers, distributors, suppliers, and retailers of consumer, pharmaceutical and industrial products of all types.

Our attorneys are active in a number of specialized product liability professional groups such as the Defense Research Institute as well as state and local bar associations. Based upon our extensive practice in product liability actions, our firm has developed a working relationship with a talented group of skilled and trial-tested consultants and expert witnesses. 

Our lawyers regularly publish and speak in the fields of product liability defense and are available to provide seminars with regard to handling product-based claims. 

 

Professional Liability

The firm handles all aspects of professional liability matters from pre-suit claims through trial. We routinely handle matters involving medical, pharmacy, real estate and design professionals in our professional liability practice. As with all of our practice areas, we aggressively pursue the most cost effective resolution.

 

Insurance Coverage

Our firm provides opinions and litigation expertise for all types of insurance coverage questions and disputes.  We represent insurers, self insured corporations, insureds and claimants. Our attorneys regularly issue coverage opinions, litigate coverage and bad faith actions and declaratory judgment actions.

The insurance coverage practice group is headed by John D. Boyle.  He has handled many coverage disputes that have been reported in Massachusetts appellate decisions. These include numerous decisions on the interpretation of the Mass Auto Policy and landmark Supreme Judicial Court decisions on coverage for intentional conduct and the insurer's duty to defend. He has also authored a number of articles on insurance coverage issues and the defense of bad faith and chapter 93A actions against insurers.

 

Motor Vehicle Litigation

The firm handles private passenger and commercial motor vehicle accident litigation for a number of insurers and self insured fleet owners.  Our attorneys have expertise in handling accident reconstruction issues for both automobiles and multi-axle vehicles.

 

Environmental

Our Environmental Practice Group represents insurers and insureds in all aspects of environmental disputes and litigation.  Our attorneys have extensive experience in environmental litigation matters, government enforcement actions, and regulatory interpretation.

Employment

Our Employment Practice Group advises clients on all aspects of the employment relationship and represents clients in federal and state courts and before administrative agencies.

 

Directors and Officers Liability

The firm handles a variety of directors and officers liability claims.

 

Workers' Compensation

The firm provides representation to insurers, third-party administrators, self-insurers, and employers in all stages of a workers’ compensation claim.  Our clients include employers in the transportation industry, construction industry, hospitality industry, manufacturing industry, and human service industry.
